Packaging legislation and compliance globally has become increasingly challenging over the past few years.

Are you scared of the unknown, the constant flux, or of making the wrong decision… and you end up waiting? Waiting for clarity, harmonisation, or for someone to tell you what you need to do?

You are not alone. Fear can be crippling and can often lead to indecision or no decision at all. However, simplifying this complex subject is essential for making informed and proactive choices. We asked sustainability expert, Gillian Garside-Wight from our specialist sister consulting company Aura-Consultants to share valuable insights on navigating the complexities of global packaging regulations and compliance.

 

The Unknown 

With regulations constantly evolving, it’s hard to keep up with the latest requirements. Each country, and sometimes even regions and states within countries, has its own set of rules regarding packaging materials (especially single-use plastics), coatings, additives, end-of-life recycling, and waste management.

Great examples of this include:

  • USA – every state has different legislative requirements, some more progressive than others
  • EU regulations – although there are 27 member states in the European Union, every member state interprets EU regulations differently

Not to mention all of these states also vary hugely in compliance reporting requirements, obligated business and reporting periods.

There are a lot of unknowns here, and unless you have a team of people constantly reviewing and keeping abreast of these changes, it can feel like you’re drowning. The good news is, there is help at hand.

The Flux

Regulations are in a state of continuous change. New directives are one thing but even existing legislation is constantly changing. Amendments to existing laws, and updates to compliance requirements can create a moving target for businesses trying to stay compliant. Never mind navigating the business requirements and global supply of packaging.

  The Wrong Decision 

Making a wrong decision based on lack of knowledge or worse, incorrect or inaccurate packaging data can lead to non-compliance, resulting in additional fees, legal issues, and reputational damage. This fear often leads businesses to adopt a wait-and-see approach, which can be equally detrimental.

  1. Stay Informed – Regularly update yourself on global packaging regulations. Subscribe to industry newsletters, join relevant associations, and participate in webinars and workshops.
  2. Use Data to Drive Decisions – Leverage packaging data to make informed decisions. Data can help you understand your current compliance status, identify gaps, and predict future compliance needs.
  3. Develop a Strong Strategy – Create a robust strategy that is achievable, yet ambitious . Incorporate aspects such as recyclability, recycled content, sustainably sourced materials, single-use plastics, and carbon analysis into your strategy.
  4. Evaluate Compliance by Territory – It’s crucial to assess your compliance needs by each territory where your products are sold. This localised approach helps in understanding specific requirements and mitigating risks.
  5. Mitigate Risks – Proactively work to mitigate risks such as higher fees, non-compliance penalties, and supply chain disruptions by keeping your packaging strategies and practices updated.
  6. Measure Success – Continuously measure and evaluate your progress towards compliance and sustainability goals. Use this data to refine your strategy and make necessary adjustments.

While the landscape of packaging legislation and compliance can be daunting, taking a proactive and informed approach can demystify the process.

It is then crucial you have live and accurate packaging data to leverage and develop a strong, strategy tailored to your countries/territories of sale.
